Dui Penalties In Pennsylvania
Pennsylvania DUI Law divides DUI offenses into three different tiers or levels, which are based upon the motorist's blood alcohol content, the presence of narcotics in the motorist's system, or even upon the motorist's refusal to submit to a chemical test of blood or breath.
An overview of Penalties for Convictions for each Tier and Offense is below:
FIRST OFFENSE DUI
FIRST OFFENSE DUI - .08% -.099% Blood Alcohol Content / General Impairment
Ungraded Misdemeanor
Up to 6 months probation
$300 fine
Alcohol highway safety school
May be Eligible for ARD (see ARD tab in this website)
FIRST OFFENSE DUI - .10%-.159% Blood Alcohol Content / General Impairment w/ Accident
Ungraded Misdemeanor
2 days (minimum) to 6 months Jail
$500 to $5,000 fine
12 month drivers license suspension
Alcohol highway safety school
Treatment when ordered
May be Eligible for ARD (see ARD tab in this website)
FIRST OFFENSE DUI - .16% or greater Blood Alcohol Content / Drugs or Narcotics / General Impairment w/ Chemical Test Refusal
Ungraded Misdemeanor
2 days (minimum) to 6 months Jail
$500 to $5,000 fine
12 month drivers license suspension

SECOND OFFENSE DUI
SECOND OFFENSE DUI - .08% -.099% Blood Alcohol Content / General Impairment

5 days (minimum) to 6 months Jail
$300 to $2,500 fine
12 month drivers license suspension
Ignition Interlock Installation
Alcohol highway safety school

SECOND OFFENSE DUI - .10%-.159% Blood Alcohol Content / General Impairment w/ Accident
Ungraded Misdemeanor
30 days (minimum) to 6 months Jail
$750 to $5,000 fine
12 month drivers license suspension
